Man accused of 1989 murder wants case dismissed

Lawyers for a Florida man charged in connection with the 1989 slaying of his then-girlfriend are asking a judge to dismiss the case.

Kim Leroy Aune, 57, of Lee County was indicted in April on first-degree murder charges in South Dakota, then arrested in Florida.

Aune is accused of shooting his girlfriend, Kimberly Eidsness, on Nov. 13, 1989, at their home east of Sioux Falls.

The night of Eidsness' death, police were called to the couple's home for a report of a shooting. Minnehaha County Sheriff's Office Capt. Paul Niedringhaus said Aune made the call.

Death penalty possible in cold case murder

Her death wasn't classified as a homicide when authorities first began investigating. New evidence linking Aune to the murder prompted the indictment.

Aune’s lawyers filed the motion to dismiss the indictment and memorandum of law in support on Nov. 3.

Details on why Aune’s lawyers are asking for the indictment to be dismissed have been sealed.

Aune has a jury trial scheduled for January 19.
